These Terms of Service ("Terms") govern your use of the website hire-omics.com and related services operated by Hire Omics LLC ("Hire Omics," "we," "us," or "our").

By accessing or using the platform, you agree to these Terms. If you do not agree, you must not use the platform.

1. Description of the Platform

Hire Omics operates an online employment marketplace that enables:

• Employers to post job opportunities
• Candidates to create profiles and upload resumes
• Employers to discover and review candidate profiles

Hire Omics provides software infrastructure only.

Hire Omics:

• is not a staffing agency
• is not a recruiter
• is not an employer
• does not participate in hiring decisions

We do not guarantee employment outcomes, candidate qualifications, or employer legitimacy.

2. Eligibility

You must be at least 18 years old to use this platform.

By using the platform you represent and warrant that:

• you are at least 18 years old
• you have the legal capacity to enter into this agreement
• your use of the platform does not violate any laws or regulations.

3. User Accounts

Users may create accounts as:

• Candidates
• Employers

Account Responsibilities

You agree that:

• information provided during registration is accurate
• you will maintain the security of your login credentials
• you are responsible for all activity under your account
• you will notify us immediately of unauthorized account access.

Hire Omics is not responsible for losses resulting from unauthorized use of your account.

4. Candidate Profiles and Resumes

Candidates may create profiles and upload resumes to the platform.

Profile Visibility

Certain portions of candidate profiles may appear as redacted preview snippets visible to general users.

Full candidate profiles and unredacted resumes are accessible only to employers with an active paid subscription.

Candidate Responsibilities

Candidates are solely responsible for:

• the accuracy of information submitted
• the legality of uploaded content
• any claims made regarding experience or qualifications.

Hire Omics does not verify:

• employment history
• education
• certifications
• identity
• references
• credentials

Employers are responsible for conducting their own due diligence.

5. Employer Accounts

Employers may purchase subscription plans allowing:

• job postings
• access to candidate profiles
• resume viewing

Employers agree to use the platform solely for legitimate hiring purposes.

Employer Obligations

Employers must comply with all applicable employment laws including:

• anti-discrimination laws
• labor regulations
• hiring compliance laws.

Employer Data Usage Restrictions

Employers may access candidate information only for evaluating candidates for employment opportunities.

Employers may not:

• sell candidate information
• distribute candidate data to third parties
• build independent databases of candidate information
• use candidate data for marketing or advertising
• scrape or bulk export candidate data
• contact candidates for non-employment purposes.

Violation may result in immediate account termination.

6. Subscription Plans and Payments

Hire Omics offers subscription plans including:

• Browse (Free)
• Inbound Hiring
• Recruiter Package
• Team Package

Payments are processed through third-party payment processors including Stripe.

Billing Terms

Subscriptions:

• renew automatically
• bill on a recurring basis
• remain active until cancelled.

You may cancel your subscription at any time.

Cancellation takes effect at the end of the current billing period.

All fees are non-refundable unless required by law.

If payment fails, we may suspend or terminate access.

7. Third-Party Services

The platform relies on third-party infrastructure providers including but not limited to:

• Webflow
• Memberstack
• Airtable
• Algolia
• Uploadcare
• Google Analytics
• Make
• Stripe

Hire Omics is not responsible for:

• outages
• interruptions
• data loss
• service disruptions
• security incidents

caused by third-party providers.

Use of such services may also be governed by their respective terms and privacy policies.

8. User Content and Intellectual Property

Users retain ownership of the content they submit including:

• resumes
• job listings
• profiles.

License to Hire Omics

By uploading content you grant Hire Omics a:

non-exclusive, worldwide, royalty-free license

to:

• host
• store
• reproduce
• display
• distribute

the content solely for operating the platform.

This license terminates when you delete your content or account, except where content has been shared with other users (e.g., resumes viewed by employers).

User Representations:

• You represent that you own or have the right to use all content you submit.
• You represent that your content does not violate any third-party intellectual property rights.

9. Prohibited Activities

Users may not:

• scrape or harvest data
• upload malicious code
• post fraudulent listings
• impersonate others
• attempt unauthorized system access
• interfere with platform operation
• violate intellectual property rights
• violate any applicable law
• Engage in any activity that could harm Hire Omics' reputation or operations

10. Platform Availability

• Hire Omics does not guarantee uninterrupted, timely, secure, or error-free access to the platform.
• We reserve the right to update, modify, suspend, or discontinue any features or the entire platform at any time without notice.
• We may perform scheduled or emergency maintenance that temporarily limits access.

11. Force Majeure

Hire Omics is not liable for failure to perform obligations due to events beyond our control including:

• natural disasters
• infrastructure failures
• internet outages
• cloud provider failures
• acts of government
• labor disputes
• cyberattacks.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
• WARRANTIES REGARDING ACCURACY, RELIABILITY, OR AVAILABILITY OF THE PLATFORM
• WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
• WARRANTIES REGARDING EMPLOYMENT OUTCOMES, CANDIDATE QUALIFICATIONS, OR EMPLOYER LEGITIMACY

HIRE OMICS DOES NOT WARRANT THAT:

• The platform will meet your requirements
• Any errors or defects will be corrected
• The platform is free from viruses or harmful components
• Results obtained from use of the platform will be accurate or reliable

We do not guarantee:

• employment outcomes
• candidate qualifications
• employer legitimacy
• uninterrupted access.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

HIRE OMICS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
• ANY DAMAGES ARISING FROM HIRING DECISIONS, EMPLOYMENT OUTCOMES, OR INTERACTIONS BETWEEN EMPLOYERS AND CANDIDATES
• ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
• ANY DAMAGES ARISING FROM THIRD-PARTY CONDUCT ON THE PLATFORM

IN NO EVENT SHALL HIRE OMICS' TOTAL LIABILITY TO YOU EXCEED THE AMOUNT PAID BY YOU TO HIRE OMICS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

USE OF THE PLATFORM IS AT YOUR OWN RISK. YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE PLATFORM AND ANY CONSEQUENCES THEREOF.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Hire Omics LLC, its officers, directors, employees, agents, affiliates, and partners from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations
• Content you submit to the platform
• Your interactions with other users

15. DMCA Copyright Policy

Hire Omics respects intellectual property rights and responds to notices of alleged copyright infringement in accordance with the DMCA.

Your notice must include:

• Identification of the copyrighted work claimed to have been infringed

• A statement that the information in the notice is accurate
• Your physical or electronic signature

Counter-Notice:If your content was removed due to a DMCA notice and you believe it was removed in error, you may file a counter-notice with the same information.

16. Termination

By Hire Omics:

• We may suspend, disable, or terminate your account at any time for any reason, including violation of these Terms.
• We may terminate accounts without notice for serious violations.

By Users:

• You may cancel your account at any time through your account settings.
• Upon cancellation, your subscription will remain active until the end of the current billing period.
• Account deletion may take up to 30 days to complete fully.

Effect of Termination:

• Upon termination, your right to use the platform ceases immediately.
• Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

17. Dispute Resolution and Arbitration

Informal Resolution:Before filing a claim, you agree to contact us at support@hire-omics.com to attempt to resolve the dispute informally.

Binding Arbitration:Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the platform shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Arbitration Terms:

• Arbitration will be conducted in Orange County, California
• The arbitrator's decision will be final and binding
• Each party will bear its own costs and attorneys' fees unless otherwise awarded by the arbitrator
• You waive your right to a jury trial
• You waive your right to participate in a class action lawsuit

Exceptions:Either party may seek injunctive or other equitable relief in court to prevent actual or threatened infringement of intellectual property rights.

30-Day Opt-Out:You may opt out of arbitration by sending written notice to support@hire-omics.com within 30 days of first accepting these Terms.

18. Governing Law

These Terms are governed by the laws of the State of California.

19. Modifications

We may modify these Terms at any time.

Changes become effective upon posting.

Continued use constitutes acceptance.

Review Responsibility:You are responsible for reviewing these Terms periodically.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the platform, constitute the entire agreement between you and Hire Omics regarding your use of the platform and supersede all prior agreements and understandings.
